بيد أنه يُعتقد أن الأفضل اعتماد المبدأ الوارد في الجملة الثانية من الفقرة 1، أي أن معيار عدم فرض ضريبة على أرباح المؤسسة إلا إذا كانت ثمة منشأة دائمة يصح تطبيقه لا على المؤسسة نفسها بل على أرباحها.
