Celní orgány mohou místo opatření uvedených v odstavcích 2 a 3 považovat celní prohlášení za neplatné, je-li nepochybné, že deklarantovo odmítnutí být přítomen při celní prohlídce zboží nebo určit osobu schopnou poskytnout jim potřebnou součinnost nebrání, ani se nesnaží bránit tomu, aby celní orgány zjistily porušení předpisů o propuštění dotyčného zboží do daného celního režimu ani aby byl použit čl. 66 odst. 1 nebo čl. 80 odst. 2 kodexu.

(4) Die Zollstelle kann anstelle der Maßnahmen nach den Absätzen 2 und 3 die Zollanmeldung als wirkungslos ansehen, wenn zweifelsfrei feststeht, daß die Weigerung des Anmelders, bei der Zollbeschau anwesend zu sein oder eine Person zu benennen, die der Zollstelle die erforderliche Unterstützung gewähren kann, nicht bezweckt oder bewirkt, daß die Zollstelle an der Feststellung einer Zuwiderhandlung gegen die Vorschriften über die Überführung der betreffenden Waren in den zollrechtlich freien Verkehr gehindert wird oder daß gegen Artikel 66 Absatz 1 oder Artikel 80 Absatz 2 des Zollkodex verstoßen wird.

4. Instead of the measures laid down in paragraphs 2 and 3, the customs authorities shall have the option of deeming a declaration invalid where it is clear that the declarant's refusal to be present at the examination of the goods or to designate a person able to give the necessary assistance neither prevents, nor seeks to prevent, those authorities from finding that the rules governing the entry of the goods for the customs procedure concerned have been breached, and neither evades, nor seeks to evade, the provisions of Article 66 (1) or Article 80 (2) of the Code.

(4) A vámhatóságnak lehetősége van, hogy a (2) és (3) bekezdésben megállapított intézkedések helyett a vámáru-nyilatkozatot érvénytelennek tekintse, amennyiben az a tény, hogy a nyilatkozattevő megtagadta az áru vámvizsgálatán való személyes részvételt, illetve helyettesítésére olyan másik személy megjelölését, aki képes megadni a vámhatóságnak a szükséges segítséget, sem célja, sem tényleges hatása szerint nem akadályozza ezt a hatóságot abban, hogy olyan megállapítást tegyen, miszerint az áruknak az érintett vámeljárás alá vonását szabályozó rendelkezéseket megsértették, illetve sem célja, sem tényleges hatása szerint nem eredményezi a Vámkódex 66. cikkének (1) bekezdésében vagy 80. cikkének (2) bekezdésében foglalt rendelkezések megkerülését.

(4) În locul aplicării măsurilor prevăzute la alineatele (2) și (3), autoritățile vamale pot considera declarația ca fiind fără efect în cazul în care nu există nici o îndoială că refuzul declarantului de a asista la verificarea mărfurilor sau de a desemna o persoană care poate oferi asistența necesară nu împiedică și nici nu este menit să împiedice respectivele autorități să constate încălcarea dispozițiilor care reglementează plasarea mărfurilor sub regimul vamal respectiv și nici nu reprezintă o sustragere de la aplicarea dispozițiilor articolului 66 alineatul (1) sau ale articolului 80 alineatul (2) din cod.
