ب) فيما يتعلق بهلاك أو تلف أو تأخر البضاعة المنقولة بحراً على مركبة طرق، تكون هناك أحكام متنازعة في اتفاقية النقل الطرقي للبضائع وفي مشروع الصك: فعملا بالـمادة # من اتفاقية النقل الطرقي للبضائع تنطبق أحكام الاتفاقية إلا إذا حدث الهلاك أو التلف أو التأخر أثناء النقل بواسطة النقل الأخرى ولم يتسبب نتيجة فعل أو إغفال من جانب الناقل الطرقي، بينما بمقتضى المادة # من مشروع الصك، ستنطبق أحكام مشروع الصك؛

b) in respect of loss, damage, or delay to goods carried by sea on a road vehicle, there are conflicting provisions in the CMR and in the Draft Instrument: pursuant to article # of the CMR, its provisions apply except if the loss, damage, or delay occurs during the carriage by the other means of transport and is not caused by an act or omission of the road carrier, while under article # of the Draft Instrument its provisions would apply; and
