وبما أن النساء اللاتي يتم استغلالهن جنسياً كثيراً ما يفتقرن إلى ما يثبت جنسيتهن أو يكن عديمات الجنسية عندما يهربن في نهاية الأمر من مستغليهن، وبما أن الأشخاص عديمي الجنسية كثيراً ما لا يعترف بهم البلد الجديد الذي يجدون أنفسهم فيه، فإن الاتفاقية المقترحة تنص على ما يلي: "يمنح مركز اللاجئ لجميع ضحايا الاستغلال الجنسي، سواء دخلوا البلد بطريقة شرعية أو غير شرعية"(41).

Because sexually exploited women often lack proof of their citizenship or are stateless when they finally escape their exploiters, and because stateless persons are often not recognized by the new country in which they find themselves, the proposed convention provides that: “refugee status shall be granted to all victims of sexual exploitation, whether they have entered the country legally or illegally”.

Puesto que las mujeres sexualmente explotadas carecen con frecuencia de una prueba de su ciudadanía o son apátridas cuando finalmente escapan a sus explotadores, y puesto que los apátridas a menudo no son reconocidos por el nuevo país en que se encuentran, la Convención propuesta estipula que: "se concederá el estatuto de refugiado a todas las víctimas de la explotación sexual, ya sea que hayan entrado legalmente o ilegalmente en el país" .
