The granting of extradition is a discretionary function of the Executive Authority and is, without prejudice to its technical, criminal and procedural aspects, which must in each case be resolved by the courts with the participation of the Government Prosecutor’s Office, subject to the Constitution and the law.

La concesión de extradición es función potestativa del poder ejecutivo, bajo el imperio de la Constitución y la Ley, sin perjuicio de su aspecto técnico penal y procesal que han de resolver los Tribunales en cada caso con la intervención del Ministerio Fiscal.

Accorder une extradition est une prérogative du pouvoir exécutif, qui l’exerce dans le cadre de la Constitution et de la loi, sous réserve de certains points techniques d’ordre pénal et procédural sur lesquels les tribunaux statuent cas par cas avec l’intervention du ministère public.
