Any person duly warned, whether on behalf of the prisoner or against him, duly to attend and give evidence on any such trial shall be bound to attend on the day appointed for the same and shall remain in attendance throughout the whole trial, and in case he fails so to attend, he shall be held guilty of contempt of court, and he may be proceeded against therefor accordingly.
