فأي تنظيم يهدف إلى ضبط الملكية أو إبطال الحق فيها لمصلحة الدولة - سواء عن طريق الحجر أو الحارسة أو المصادرة أو وضع اليد أو تعطيل سلطة التصرف في الممتلكات المتصلة بأنشطة غير مشروعة - ينبغي أن يتم استثنائيا عن طريق السلطة القضائية وفقا لما ينص عليه الاستثناء من حق الملكية المنصوص عليه في المادة 34 من الدستور السياسي.

Any measure taken to obtain for the State the confiscation or termination of ownership — freezing, attachment, seizure, arrest, possession or suspension of dispositive power — of assets linked to illicit activities, must be taken exclusively through judicial channels, in accordance with the provision on termination of ownership rights contained in article 34 of the Political Constitution.

Toda afectación dirigida a obtener en favor del Estado el comiso o la extinción del derecho del dominio —embargo, secuestro, incautación, aprehensión, ocupación o suspensión del poder dispositivo— de bienes relacionados con actividades ilícitas, procede exclusivamente por vía judicial, conforme lo dispone la excepción al derecho de propiedad consagrada en al artículo 34 de la Constitución Política.
