Für die von den Bedingungen dieses Artikels betroffenen Personen sollte umfassende Rechtssicherheit gewährleistet werden; daher sollte die Kommission den Begriff "wesentliche" Tätigkeit klarer definieren und quantifizieren, um keinen Raum für eine ermessensmißbräuchliche oder subjektive Anwendung der Rechtsvorschrift zu lassen, und zu gegebener Zeit die diesbezüglich zu erwartende Rechtsprechung des Gerichtshofs der Europäischen Gemeinschaften berücksichtigen.

Η νομική ασφάλεια των ατόμων που επηρεάζονται από τις συνθήκες που περιγράφονται στο άρθρο θα πρέπει να διασφαλισθεί καταλλήλως, και γι' αυτό θα πρέπει να ζητηθεί από την Επιτροπή να προσδιορίσει σαφώς τι σημαίνει "ουσιαστική" δραστηριότητα, και να την καθορίσει ποσοτικώς έτσι ώστε να μην υπάρξει η παραμικρή περίπτωση αυθαιρεσίας ή υποκειμενικότητας κατά την εφαρμογή του κανονισμού, καθώς και να λάβει υπόψη την κατάλληλη στιγμή την απόφαση που αναμένεται να εκδώσει το Ευρωπαϊκό Δικαστήριο για το θέμα αυτό.

The legal certainty of the persons covered by the conditions described in the article must be adequately ensured. The Commission should therefore be urged to define clearly what is meant by "substantial" activity, in terms of precise figures, leaving no room for arbitrary or subjective application of the rules and taking the expected judgement of the EC Court of Justice on this matter, when it comes, into account.

La seguridad jurídica de las personas afectadas por las condiciones descritas en el artículo debería estar debidamente garantizada, por lo que habría que instar a la Comisión para que definiera claramente qué quiere decir actividad "sustancial", cuantificándola debidamente para que no quede el menor resquicio a la arbitrariedad o a la subjetividad en la aplicación de la norma, teniendo en cuenta, en su momento, el previsto pronunciamiento que el Tribunal de Justicia de las Comunidades Europeas realice sobre esta materia.

La sicurezza giuridica delle persone interessate dalle condizioni descritte nell'articolo dovrebbe essere debitamente garantita, per cui occorrerebbe sollecitare la Commissione a definire chiaramente cosa intende per "attività sostanziale" e a quantificarla adeguatamente per lasciare il minor spazio possibile all'arbitrarietà o alla soggettività nell'applicazione della norma, tenendo conto, a tempo debito, della prevista sentenza della Corte di giustizia delle Comunità europee in materia.

A segurança jurídica das pessoas abrangidas pelas condições descritas no artigo deveria estar devidamente garantida, motivo por que haveria que instar com a Comissão para que definisse mais claramente o que pretende dizer com actividade substancial, quantificando-a devidamente para que não haja a menor hipótese de arbitrariedade ou subjectividade na aplicação da norma, tendo em conta, oportunamente, o previsto acórdão do Tribunal de Justiça das Comunidades Europeias sobre tal matéria.
