In the absence of a legislative provision denying the adjudicator’s authority to hear and rule on the group grievance under the present circumstances, we believe the adjudicator should find not only that he has jurisdiction, but that he should continue to hear the individual grievances together, as a group, so that he may properly focus his attention on the actions taken by the employer when it instituted shift changes in violation of the Collective Agreement.

En l’absence d’une disposition législative interdisant à l’arbitre de grief d’entendre le grief qui nous intéresse ici et de statuer à son sujet, nous estimons que l’arbitre de grief non seulement devrait conclure qu’il possède la compétence voulue, mais qu’il devrait continuer à entendre les griefs individuels ensemble, en tant que groupe, afin qu’il puisse bien diriger son attention sur les mesures prises par l’employeur, lorsqu’il a institué des changements dans les quarts et ainsi a contrevenu à la convention collective.
