The lack of precision of the standard cited, combined with the undeniable difficulty involved in the consideration of economic, social, and cultural rights, have brought about the inoperability, in practice, of Article 42 of the American Convention, which establishes the obligation of the member states to transmit to the Inter-American Commission on Human Rights a copy of each of the reports and studies that they submit annually to the Executive Committee of the Inter-American Economic and Social Council and the Inter-American Council for Education, Science, and Culture, so that the IACHR may monitor the promotion of the rights implicit in the standards set forth in the OAS Charter.

La falta de precisión de la norma transcrita unida a la indudable dificultad que encierra la consideración de los derechos económicos, sociales y culturales, ha determinado la inoperancia práctica del artículo 42 de la Convención Americana que establece la obligación de los Estados de remitir a la Comisión Interamericana de Derechos Humanos copia de los informes presentados a las Comisiones Ejecutivas del Consejo Interamericano Económico y Social y del Consejo Interamericano para la Educación, la Ciencia y la Cultura, a fin de que la CIDH vele por la promoción de los derechos mencionados en la Carta de la OEA.
