Εν προκειμένω, η δανική κυβέρνηση αντλεί από αυτό ένα επιχείρημα προς στήριξη του προαναφερθέντος εξ αντιδιαστολής συναγομένου συμπεράσματος: δεδομένου ότι υπάρχει αμφιβολία σχετικά με το ζήτημα αν το Συμβούλιο σκόπευε πράγματι να κάνει διάκριση, όσον αφορά τις επιστροφές, μεταξύ του τυριού Grana Padano που δικαιούται της ιταλικής ονομασίας προελεύσεως και άλλων τυριών Grana, το άρθρο 17, παράγραφος 2, επιβάλλει να επιλεγεί η ερμηνεία κατά την οποία όλα τα τυριά τύπου Grana της Κοινότητας τυγχάνουν της ιδίας μεταχειρίσεως από άποψη επιστροφών λόγω εξαγωγής.

In this case, the Danish Government uses that as an argument in support of its reasoning a contrario : since it is questionable whether the Council wished to draw a distinction between Grana Padano with an Italian designation of origin and other types of Grana in connection with the grant of refunds, it is necessary in the light of Article 17(2 ) to opt for the interpretation according to which all Grana-type cheeses within the Community are to be accorded equal treatment for the purposes of the grant of export refunds .

En el presente caso el Gobierno danés argumenta de acuerdo con su razonamiento a contrario antes enunciado: dado que existe una duda sobre si el Consejo pretendía efectivamente hacer una distinción, en materia de restituciones, entre el queso Grana Padano con derecho a la denominación de origen italiana y los otros quesos Grana, el apartado 2 del artículo 17 obliga a interpretar que todos los quesos del tipo Grana de la Comunidad disfrutan del mismo trato en materia de restituciones a la exportación.

En l' espèce, le gouvernement danois en tire argument à l' appui de son raisonnement a contrario énoncé ci-dessus : étant donné qu' il existe un doute sur la question de savoir si le Conseil entendait effectivement faire une distinction, en matière de restitutions, entre le fromage Grana Padano ayant droit à l' appellation d' origine italienne et d' autres fromages Grana, l' article 17, paragraphe 2, impose de choisir l' interprétation selon laquelle tous les fromages de type Grana de la Communauté bénéficient du même traitement en matière de restitutions à l' exportation .

No caso em apreço, o Governo dinamarquês extrai daí o argumento em apoio do seu raciocínio a contrario enunciado mais acima: dado que existe uma dúvida sobre a questão de saber se o Conselho pretendia efectivamente fazer uma distinção em matéria de restituições, entre o queijo Grana Padano com direito a denominação de origem italiana e outros queijos Grana, o n.° 2 do artigo 17.° impõe que se escolha a interpretação segundo a qual todos os queijo de tipo Grana da Comunidade beneficiam do mesmo tratamento em matéria de restituições à exportação.
