The Human Rights Committee has stated its view that, though not so specified in the Covenant on Civil and Political Rights, the right of persons in detention to be treated with humanity and with respect for the inherent dignity of the human person is non-derogable, placing an absolute obligation on States.9 The Committee found this right to have been violated in case No. 577/1994, in which an accused terrorist (convicted after nine months) was held incommunicado, denied access to counsel for at least nine months after arrest and to his family for nearly two years, and was held in a state of isolation for 23 hours a day in a small cell, with no more than 10 minutes of sunlight a day.
