إنّ سكوت الفقرة 3 من هذه المادة من الاتفاقية عن "إعفاء الناقل من المسؤولية عن الأخطاء البحرية"، مثل مسؤولية القبطان والربان عن الأخطاء في قيادة السفينة وإدارتها، يزيد بقدر كبير من مسؤولية الناقل ويؤثر سلباً على العلاقة المتوازنة نسبيا في الحقوق والواجبات بين الناقل وصاحب البضائع.

The fact that paragraph 3 of this article does not provide for “the exemption of carrier from the liability for nautical faults”, i.e. the liability of the captain and the pilot for faults in piloting and managing the ship, will greatly increase the responsibility of the carrier, and will severely affect the relatively balanced relationship of rights and obligations between the carrier and the owner of the goods.

El hecho de que el párrafo 3 de este artículo no contemple la “exoneración de responsabilidad del porteador por error de navegación”, por ejemplo, la responsabilidad del capitán y el piloto por error en el pilotaje y la administración del buque, ha de aumentar considerablemente la responsabilidad del porteador, y afectará gravemente la relación relativamente equilibrada de derechos y obligaciones entre el porteador y el propietario de las mercancías.

Тот факт, что в пункте 3 этой статьи не предусмотрено "освобождение перевозчика от ответственности за навигационные ошибки", т.е. ответственности капитана и лоцмана за ошибки в лоцманской проводке и управлении морским судном, значительно повышает уровень ответственности перевозчика и серьезно затрагивает относительную сбалансированность прав и обязанностей перевозчика и владельца груза.
