The fundamental purpose of the legislation is "... to help those members of the workforce who lose their employment and are unable to find immediately another one in replacement." (22) Courts have observed that the focus of the legislation is the circumstances surrounding employment and unemployment, and not the formation of families (23), and that the plan is primarily an insurance scheme to help those who are capable of working, not a disability insurance scheme.
