والواقع أن من الصعب على هيئة من الهيئات أن تقوم بالمهمة التي تتمثل، في مرحلة أولى وفي إطار إجراء النظر في التقارير الدورية، في الدخول في مناقشة بناءة مع الدولة الطرف بشأن التدابير والآليات الموضوعة بغرض الإعمال الكامل للحقوق المنصوص عليها في هذه الاتفاقية الدولية أو تلك - وهو نشاط ذو طبيعة ودية واستشارية أساساً -، وفي مرحلة ثانية، في التصرف كجهة شبه قضائيـة للتحقيق أو التسوية.

It is a hard assignment for one body, first to engage a State party in constructive, fruitful dialogue, during the consideration of periodic reports, on the steps it has taken and the machinery it has established to give full effect to the rights set forth in some international convention - essentially a non-confrontational, consultative exercise - and then to behave as a quasi-judicial investigative and settlement body.

De hecho, es difícil que un órgano cumpla una misión que consiste, en un primer momento y en el marco del procedimiento de examen de los informes periódicos, en entablar un debate constructivo y fructífero con el Estado Parte sobre las medidas y los mecanismos establecidos para lograr el pleno ejercicio de los derechos enunciados en un convenio internacional determinado (actividad esencialmente de carácter voluntario y consultivo) y en un segundo tiempo, en actuar como instancia cuasijurisdiccional de investigación y solución.

En effet, il est difficile pour un organe de mener la mission consistant, dans un premier temps et dans le cadre de la procédure d’examen des rapports périodiques, à engager un débat constructif et fructueux avec l’État partie sur les mesures et mécanismes mis en place en vue de la pleine réalisation des droits énoncés dans telle ou telle convention internationale − activité de nature essentiellement gracieuse et consultative −, et, dans un deuxième temps, à agir comme une instance quasi juridictionnelle d’enquête et de règlement.

И действительно, трудно вести работу по рассмотрению периодических докладов, организовывать конструктивный и плодотворный обмен мнениями с государством-участником относительно мер и механизмов, создаваемых в целях полного осуществления прав, изложенных в той или иной международной конвенции, - эта задача по сути своей связана с рекомендациями и консультациями - и одновременно с этим выступать в качестве квазисудебной инстанции по расследованию и урегулированию.
