As for the rights of the accused, article 127 of the Code sets out the following rights, among others: “ ... to communicate with his or her family members and with a lawyer of his or her choosing or a legal aid association, in order to inform them of his or her arrest; to be assisted, from the initial stages of the investigation, by a counsel appointed by him- or herself or his or her relations or, failing that, by a court-appointed counsel; to be assisted free of charge by a translator or interpreter if he or she does not understand or speak Spanish; ... not to be subjected to torture or other cruel, inhuman or degrading treatment; and not to be subjected to techniques or methods that impair his or her free will, even with his or her consent.”

Sobre los derechos que asisten a los imputados el artículo 127 eiusdem señala entre otros: “...comunicarse con sus familiares, abogado de su confianza o asociación de asistencia jurídica, para informar sobre su detención; ser asistido, desde los actos iniciales de la investigación, por un defensor que designe él o sus parientes y, en su defecto, por un defensor público; ser asistido gratuitamente por un traductor o intérprete si no comprende o no habla el idioma castellano; no ser sometido a tortura u otros tratos crueles, inhumanos o degradantes de su dignidad personal, no ser objeto de técnicas o métodos que alteren su libre voluntad, incluso con su consentimiento”

L’article 127 dudit code énonce, entre autres droits reconnus au prévenu, celui de «... communiquer avec ses proches, une personne de confiance ou un cabinet d’aide juridictionnelle, pour les informer de son arrestation; d’être assisté, dès les premiers actes de l’enquête, par un avocat désigné par lui ou ses proches et, à défaut, un défenseur public; d’être assisté gratuitement d’un traducteur ou interprète s’il ne parle ni ne comprend la langue espagnole, de ne pas être soumis à la torture ou autres traitements cruels, inhumains ou dégradants, de ne pas être l’objet de techniques ou méthodes qui portent atteinte à son libre arbitre, même s’il y consent».
