وقضت المحكمة، في قبولها للاستئناف، بأنه على الرغم من أن لحكم محكمة نيويورك دلالات الأحكام الشخصية فهو مع ذلك حكم "لأغراض نظام الإنفاذ الجماعي لإجراءات الإعسار" ويكون بذلك محكوماً بالقانون الدولي الخاص المتعلق بالإفلاس ولا يخضع لقواعد القانون الدولي الخاص العادي التي تمنع إنفاذ هذه الأحكام لأن المدعى عليهم لا يخضعون للولاية القضائية للمحكمة الأجنبية.

Allowing the appeal, the court held that although the judgement of the New York court had the indicia of judgements in personam, they were nonetheless judgements “in and for the purposes of the collective enforcement regime of the insolvency proceedings” and as such were governed by the private international law relating to bankruptcy and not subject to the ordinary private international law rules that would prevent enforcement of these judgements because the defendants were not subject to the jurisdiction of the foreign court.

Al estimar la apelación, el tribunal sostuvo que si bien la sentencia del tribunal de Nueva York tenía indicios de una sentencia in personam, era, sin embargo, una sentencia dictada a los efectos del régimen de ejecución colectiva del procedimiento de insolvencia y, como tal, se regía por el derecho internacional privado relativo a la insolvencia y no estaba sujeta a las reglas ordinarias de derecho internacional privado que impedirían la ejecución de este tipo de sentencias debido a que los demandados no estaban sujetos a la jurisdicción del tribunal extranjero.
