Einer Übernahme der Bauten, Teile von Bauten oder Bauabschnitte durch den Auftraggeber muss eine vorläufige Teilabnahme vorausgehen. In dringenden Fällen kann die Übernahme jedoch vor der Abnahme erfolgen, sofern zuvor eine Bestandsaufnahme der noch durchzuführenden Arbeiten von der Aufsicht erstellt und von dem Auftragnehmer und der Aufsicht gebilligt worden ist. Hat der Auftraggeber die Bauten, Teile von Bauten oder Bauabschnitte in Besitz genommen, so kann der Auftragnehmer nicht mehr zur Behebung von Schäden herangezogen werden, es sei denn, sie gehen auf Konstructionsfehler oder unsachgemässe Ausführung zurück

Any taking over of the structures, parts of structures or sections of the works by the contracting authority shall be preceded by their partial provisional acceptance. However, works may in cases of urgency be taken over prior to acceptance provided an inventory of outstanding work is drawn up by the supervisor and agreed to by the contractor and the supervisor beforehand. Once the contracting authority has taken possession of a structure, a part thereof or section of the works, the contractor shall no longer be required to make good any damage resulting otherwise than from faulty construction or workmanship
