وأشار إلى أن قانون البحار يوفر، على النحو الوارد في المادة 234 من اتفاقية الأمم المتحدة لقانون البحار، إطارا أساسيا للإشراف على الملاحة البحرية في القطب الشمالي ومَنَحَ الدول الساحلية الحق في اتخاذ قوانين ولوائح غير تمييزية وإنفاذها من أجل منع التلوث البحري الناجم عن السفن والحد منه ومراقبته في المياه المغطاة بالجليد، وأن المنظمة البحرية الدولية هي الوكالة المختصة من وكالات الأمم المتحدة التي تتولى مسؤولية القضايا المتصلة بالميدان البحري العالمي.

It noted that the law of the sea as reflected in the United Nations Convention on the Law of the Sea, in article 234, provided a fundamental framework for the governance of Arctic marine navigation and allowed coastal States the right to adopt and enforce non-discriminatory laws and regulations for the prevention, reduction and control of marine pollution from vessels in ice-covered waters, and that IMO is the competent United Nations agency with responsibility for issues related to the global maritime industry.

Se señaló que el derecho del mar, tal como había sido plasmado en el artículo 234 de la Convención de las Naciones Unidas sobre el Derecho del Mar, constituía un marco fundamental para la gobernanza de la navegación marítima en el Ártico y otorgaba a los Estados ribereños el derecho a dictar y hacer cumplir leyes y reglamentos no discriminatorios para prevenir, reducir y controlar la contaminación del medio marino causada por buques en las zonas cubiertas de hielo y que la OMI era el organismo de las Naciones Unidas competente para ello y responsable de las cuestiones relacionadas con la industria marítima mundial.

Там отмечено, что нормы морского права, нашедшие отражение в Конвенции Организации Объединенных Наций по морскому праву, задают основополагающие рамки для управления арктическим мореплаванием, причем в статье 234 прибрежным государствам предоставляется право принимать и обеспечивать соблюдение недискриминационных законов и правил по предотвращению, сокращению и сохранению под контролем загрязнения морской среды с судов в покрытых льдом районах, и что ИМО является компетентным учреждением Организации Объединенных Наций, отвечающим за вопросы, касающиеся мировой морской индустрии.
