وانتهاك الدولة لهذا الالتزام تعزز بصورة أكبر من خلال فشلها في حماية حقوق مجتمعات المايا من الانتهاكات من جانب الشركات التجارية وفي توفير سبل انتصاف فعالة لمعالجة انتهاكات حقوق السكان الأصليين من جانب هذه الكيانات، عملاً بالمبادئ التوجيهية المتعلقة بالأعمال التجارية وحقوق الإنسان(66).

The State’s violation of this obligation was further reinforced by its failure to protect the rights of the Maya communities against abuses by business enterprises and to implement effective remedies to redress violations of indigenous rights by such entities, pursuant to the Guiding Principles on Business and Human Rights.
