وتتمثل وظيفة الحق الضماني في التقليل من احتمال الخسارة الناجمة عن التقصير في السداد، بإعطاء الدائن المضمون حقَّ المطالبة بقيمة الموجودات المرهونة بالحق الضماني باعتبارها مصدر سداد احتياطي له الأفضلية على مطالبات دائني المانح الآخرين.

B). The function of a security right is to mitigate the risk of loss resulting from a default in payment by entitling the secured creditor to claim the value of the assets encumbered by the security right as a back-up source of repayment in preference to the claims of the grantor’s other creditors.
