Mr. Worobetz testified that he was aware that he was a casual employee but he had the expectation and hope that eventually he would be granted permanent employment status. Mr. Worobetz acknowledged on cross examination that he understood that he had made mis-sorts but he did not appreciate that mis-sorts were unacceptable.

Au cours du contre-interrogatoire, il a reconnu avoir fait des erreurs de tri, sans toutefois se rendre compte que ces erreurs étaient inacceptables. Essentiellement, il ne s'est pas rendu compte que la Société canadienne des postes visait un taux d'exactitude des tris qui s'approchait des 100 pour 100.
