Det er nødvendigt at fjerne de undtagelser, der er omhandlet i artikel 2 i direktiv 87/102/EØF, og som vedrører minimums- og maksimumsbeløb, rente- og omkostningsfri kredit, kredit med nedsatte renter og omkostninger, leasing af varer eller tjenesteydelser med forkøbsret, aftaler om forbrugerkredit, der er bekræftet af en notar eller dommer, træk på løbende konto, stiltiende overtræk eller overtræk uden bemyndigelse samt enhver form for kortfristet kredit, som medfører omkostninger eller renteudgifter for forbrugeren [12].

Wegfallen sollen die in Artikel 2 der Richtlinie 87/102/EWG aufgezählten Ausnahmen, die sich auf Unter- bzw. Obergrenzen, auf kostenlose Kredite oder Kredite zu ermäßigten Zinssätzen, auf Mietverträge mit Kaufoption für Waren oder Dienstleistungen, auf notariell beglaubigte Kreditverträge, auf Kontokorrentkredite, auf genehmigte, nicht genehmigte oder stillschweigend eingeräumte Überziehungskredite oder auf jede Form des kurzfristigen Kredits beziehen, die für den Verbraucher mit Kosten oder Zinsen verbunden ist [12].

Πρέπει να καταργηθούν οι εξαιρέσεις που προβλέπονται στο άρθρο 2 της οδηγίας 87/102/ΕΟΚ, οι οποίες αφορούν τα κατώτατα και ανώτατα όρια, τις άτοκες ή με χαμηλό επιτόκιο πιστώσεις, τις συμβάσεις μίσθωσης αγαθών ή υπηρεσιών με δικαίωμα αγοράς, τις συμβάσεις πίστωσης που έχουν τη μορφή δημοσίου εγγράφου, τις προκαταβολές σε τρεχούμενο λογαριασμό, τις εγκεκριμένες, μη εγκεκριμένες ή σιωπηρές υπεραναλήψεις, καθώς και όλες τις μορφές πιστώσεων βραχείας διάρκειας που επιβαρύνουν τον καταναλωτή με έξοδα ή τόκους [12].

The exemptions permitted by Article 2 of Directive 87/102/EEC concerning minimum and maximum amounts, free credit or credit at a reduced rate of interest, hiring agreements with an option to purchase goods or services, credit agreements in the form of an authentic act, credit in the form of advances on a current account, authorised, non-authorised or tacit overdraft as well as any other form of short-term credit involving charges or interest to the consumer need to be removed. Cabe suprimir las excepciones previstas en el artículo 2 de la Directiva 87/102/CEE relativas a los importes mínimos y máximos, el crédito gratuito o a un tipo reducido, el arrendamiento con opción de compra de bienes o servicios, los contratos de crédito en forma de documento auténtico, los anticipos en cuentas corrientes, los rebasamientos de límites autorizados, no autorizados o tácitos, así como toda forma de crédito de corta duración, que implique gastos o intereses para el consumidor [12].

È opportuno sopprimere le esenzioni di cui all'articolo 2 della direttiva 87/102/CEE che si riferiscono alle soglie, ai massimali, al credito gratuito o a tasso ridotto, alla locazione che comprende un'opzione d'acquisto di beni o di servizi, al credito sotto forma di atto autentico, agli anticipi di conto corrente, agli sconfini autorizzati, non autorizzati o taciti, nonché a tutte le forme di credito di breve durata che comportano costi o interessi per il consumatore [12].
