In accordance with the stipulations provided by the IACHR in the sentence of Velásquez Rodríguez v. Honduras, the first case to be decided by that body, the interpretation of Article 1.1, which brings the so-called general guarantee clause, combined with the other articles that spell out individual rights, leads to the conclusion that the state’s duty to promote human rights is not confined to mere abstention from violations of human rights.

De acuerdo a lo establecido por la Corte IDH desde la sentencia en la causa Velasquez Rodrigues versus Honduras, el primero que decidió este organismo, la interpretación del artículo 1.1, que trae la llamada cláusula general de garantía, combinado con los demás artículos que enuncian los derechos de los individuos, lleva a concluir que el deber del Estado en la promoción de los derechos humanos no se agota en la mera abstención de la violación de los mismos.
