2.3 The Ombudsman takes the view that the procedure described in the Commission’s Communication appears to provide unsuccessful tenderers and candidates with the opportunity to bring judicial proceedings to challenge an award decision and to have that decision set aside before the relevant contract is signed.119 The Ombudsman therefore considers that the Commission has taken steps to provide bidders in its tender procedures with access to a review procedure of the kind foreseen in the Alcatel judgement and so finds no maladministration by the Commission.
