ومنح حقوق الملكية الفكرية في شكل براءات اختراع أو حقوق لمربي النباتات هو أمر تبرره بالدرجة الأولى الحاجة إلى تشجيع هذه الابتكارات، بالسماح بمكافأة صاحب البراءة أو المربي مقابل الاستثمار في استحداث الصنف الجديد، باتباع نموذج تربية النباتات تجاريا المستخدم عادة في البلدان الصناعية.

The granting of intellectual property rights in the form of patents or plant breeders’ rights is primarily justified by the need to encourage such innovations, by allowing the patent-holder or the breeder to be rewarded for the investment made in the development of a new variety, following a model of commercial plant breeding typical of industrialized countries.
