On 27 August 1971 Cinoco brought proceedings against Soenen in the Courtrai Tribunal de commerce, claiming an infringement of the trade mark and design "Advocaat Zwarte Kip" and applying for an injunction forbidding him to exploit it. On 24 May 1973 the Tribunal de Commerce gave judgment in favour of Cinoco without taking into account the provisions of the EEC Treaty. This judgment granted an absolute territorial protection in respect of the trademark. On 30 July 1973 Soenen appealed against the judgment to the Court of Appeal at Ghent. This Court has adjourned indefinitely the hearing of the appeal.

Op 27 augustus 1971 heeft Cinoco Soenen gedagvaard voor de Rechtbank van koophandel te Kortrijk ten einde hem schuldig te doen verklaren aan namaking van het verbaal en figuratief merk Advocaat Zwarte Kip en hem het verbod op te leggen dit merk te gebruiken ; op 24 mei 1973 heeft de Rechtbank van koophandel te Kortrijk een vonnis geveld dat deze eis inwilligde , zonder rekening te houden met de bepalingen van het E.E.G.-Verdrag ; dit vonnis heeft tengevolge een absolute gebiedsbescherming toe te laten ; Soenen heeft op 30 juli 1973 hoger beroep ingesteld bij het Hof van Beroep te Gent , waar de procedure thans is geschorst ;
