1 Ved staevning indgivet til Domstolens Justitskontor den 1. april 1992 har Kommissionen for De Europaeiske Faellesskaber i medfoer af EOEF-traktatens artikel 169 anlagt sag med paastand om, at det fastslaas, at Den Italienske Republik har undladt at opfylde sine forpligtelser i henhold til Raadets direktiv 71/305/EOEF af 26. juli 1971 om samordning af fremgangsmaaderne med hensyn til indgaaelse af offentlige bygge- og anlaegskontrakter (EFT 1971 II, s. 613, herefter benaevnt "direktivet"), idet den har undladt at tilstille Kontoret for De Europaeiske Faellesskabers Officielle Publikationer en licitationsbekendtgoerelse vedroerende bygning af et lavinedige i Colle Isarco/Brennero med henblik paa offentliggoerelse i De Europaeiske Faellesskabers Tidende.

1 Με δικόγραφο που κατέθεσε στη Γραμματεία του Δικαστηρίου την 1η Απριλίου 1992, η Επιτροπή των Ευρωπαϊκών Κοινοτήτων άσκησε, δυνάμει του άρθρου 169 της Συνθήκης ΕΟΚ, προσφυγή με αίτημα να αναγνωριστεί ότι η Ιταλική Δημοκρατία, παραλείποντας να αποστείλει στην Υπηρεσία Επισήμων Εκδόσεων των Ευρωπαϊκών Κοινοτήτων, προς δημοσίευση στην Επίσημη Εφημερίδα των Ευρωπαϊκών Κοινοτήτων, προκήρυξη διαγωνισμού για την ανάθεση της κατασκευής ενός προστατευτικού φράγματος κατά των χιονοστιβάδων στην τοποθεσία Colle Isarco/Brennero, παρέβη τις υποχρεώσεις που υπέχει από την οδηγία 71/305/ΕΟΚ του Συμβουλίου, της 26ης Ιουλίου 1971, περί συντονισμού των διαδικασιών για τη σύναψη συμβάσεων δημοσίων έργων (ΕΕ ειδ. έκδ 17/001, σ. 7, στο εξής: οδηγία).

1 By application lodged at the Court Registry on 1 April 1992, the Commission of the European Communities brought an action under Article 169 of the EEC Treaty for a declaration that, by failing to send to the Office for Official Publications of the European Communities for publication in the Official Journal of the European Communities a contract notice for the construction of an avalanche barrier in the locality of Colle Isarco/Brennero, the Italian Republic has failed to fulfil its obligations under Council Directive 71/305/EEC of 26 July 1971 concerning the coordination of procedures for the award of public works contracts (OJ, English Special Edition 1971 (II), p. 682).

1 Con atto introduttivo depositato in cancelleria il 1 aprile 1992, la Commissione delle Comunità europee ha proposto, ai sensi dell' art. 169 del Trattato CEE, un ricorso diretto a far dichiarare che la Repubblica italiana, avendo omesso di inviare all' Ufficio delle pubblicazioni ufficiali delle Comunità europee, ai fini della pubblicazione nella Gazzetta ufficiale delle Comunità europee, un bando di gara per la costruzione di una diga paravalanghe in località Colle Isarco/Brennero, è venuta meno agli obblighi che le incombono ai sensi della direttiva del Consiglio 26 luglio 1971, 71/305/CEE, che coordina le procedure di aggiudicazione degli appalti di lavori pubblici (GU L 185, pag. 5, in prosieguo: la "direttiva").

1 Bij verzoekschrift, neergelegd ter griffie van het Hof op 1 april 1992, heeft de Commissie van de Europese Gemeenschappen krachtens artikel 169 EEG-Verdrag het Hof verzocht vast te stellen dat de Italiaanse Republiek, door na te laten het Bureau voor officiële publikaties der Europese Gemeenschappen een aankondiging van de voorgenomen opdracht voor de aanleg van een lawinewering in Colle Isarco/Brennero toe te zenden voor bekendmaking in het Publikatieblad van de Europese Gemeenschappen de verplichtingen niet is nagekomen die op haar rusten krachtens richtlijn 71/305/EEG van de Raad van 26 juli 1971 betreffende de cooerdinatie van de procedures voor het plaatsen van overheidsopdrachten voor de uitvoering van werken (PB 1971, L 185, blz. 5; hierna: "richtlijn").
