ولوحظ أيضا أن النص على أن الالتزام بتقديم المطالبة ينطبق على جميع الدائنين، سواء أكانوا أم لم يكونوا مكفولين بضمان، أمر ضروري لضمان أن يكون ممثل الإعسار على علم بجميع المطالبات المكفولة بضمان وعلى علم بالمبلغ المتبقي من الدين.
