Поскольку национальный, региональный и международный опыт свидетельствует о том, что широкий правовой вопрос о возможности защиты в судебном порядке экономических, социальных и культурных прав, в том числе изложенных в МПЭСКП, уже решен, он призвал Рабочую группу сосредоточить внимание на конкретных правовых вопросах, все еще нуждающихся в рассмотрении, - например о том, кто должен иметь право подавать жалобу, и о том, следует ли предусмотреть в факультативном протоколе процедуры, касающиеся как подачи жалоб, так и их рассмотрения.
