وتجدر الإشارة إلى أن اشتراط التسليم أو المحاكمة، ما بعد تطبيقه في القانون الجنائي الدولي العرفي وفي القانون الدولي التعاهدي (المستند إلى المعاهدات) من قبيل اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة [...]، هو اشتراط إلزامي، ورد ذكره مرارا.
