والمبلغ الأقصى للغرامة المدنية هو المبلغ الأكبر من أحد المبالغ التالية: 10 مليون دولار أسترالي؛ أو ثلاثة أضعاف إجمالي قيمة الفوائد المحصلة نتيجة ارتكاب المخالفة أو الفعل أو التقصير المخالف للحظر المدني؛ أو، إذا تعذر تحديد تلك الفوائد بالكامل، 10 في المائة من رقم أعمال المجموعة السنوي في فترة الأشهر الإثني عشر التي سبقت حدوث المخالفة أو الانتهاك.

The maximum amount of the civil penalty is the greater of: $A 10 million; or three times the total value of the benefit obtained from the commission of the offence or the act or omission in contravention of the civil prohibition; or where those benefits cannot be fully determined, 10 per cent of the corporate group’s annual turnover in a 12-month period preceding the offence or contravention.

La cuantía máxima de la multa civil es la mayor: 10 millones de dólares australianos; o tres veces el valor total de los beneficios obtenidos gracias a la comisión del delito, o el acto de omisión, en contravención de la prohibición civil; o, en caso de que no se hayan podido determinar plenamente los beneficios, del 10% del volumen de negocios anual de la empresa en los 12 meses previos a la comisión del delito o contravención.
