Nařízení EP a Rady (ES) 1008/2008 – žádný podnik ve společenství nesmí provozovat leteckou přepravu cestujících (vztaženo i na HEMS) bez provozní licence (podnikem je přitom dle výkladu ESD i organizační složka státu).

Regulation (EC) No 1008/2008 of the European Parliament and of the Council stipulates that no undertaking in the Community is permitted to carry passengers by air (this applies to HEMS flights, too) without an operating licence (in the ECJ’s interpretation a public service entity is also an undertaking in this sense).
