باستثناء الحكم المتعلق بالوقت المتاح لرفع الدعوى، تقرر أحكام هذا الصك المتعلقة بمسؤولية الناقل عن هلاك البضاعة أو تلفها أيضا ما اذا كان يجوز للمرسل إليه أن يرفض الإسهام في العوارية العامة، ومدى مسؤولية الناقل عن تعويض المرسل إليه عما قدمه من اسهام أو ما دفعه من تكاليف انفاذ.

With the exception of the provision on time for suit, the provisions of this instrument relating to the liability of the carrier for loss of or damage to the goods also determine whether the consignee may refuse contribution in general average and the liability of the carrier to indemnify the consignee in respect of any such contribution made or any salvage paid.

Con la excepción de la disposición relativa al plazo para la presentación de la demanda, las disposiciones del presente instrumento relativas a la responsabilidad del porteador por pérdida o daño de las mercancías determinarán también si el consignatario puede negarse a contribuir en caso de avería gruesa y si el porteador es responsable de resarcir al consignatario de su contribución a la avería gruesa o al salvamento si lo hubiere.

À l’exception de la disposition relative au délai pour agir, les dispositions du présent instrument qui régissent la responsabilité du transporteur pour pertes ou dommages subis par les marchandises déterminent aussi la question de savoir si le destinataire peut refuser de contribuer aux avaries communes et si le transporteur est tenu d'indemniser le destinataire de sa contribution éventuelle aux avaries communes ou aux frais de sauvetage.

С исключением положения о сроке исковой давности, положения настоящего документа, касающиеся ответственности перевозчика за утрату или повреждение груза, определяют также, может ли грузополучатель отказаться от уплаты взноса по общей аварии, и обязанность перевозчика компенсировать грузополучателю оплату им такого взноса или расходов по спасанию.
