The Court therefore ruled that the Italian system of differential taxation in the form of tax banderoles was contrary to Article 95 of the Treaty as regards the taxation of alcoholic beverages which were the result of the distillation of cereals and sugar cane, on the one hand, and spirits obtained from wine and marc on the other .
