Selv hvad angaar kravene i artikel 8 i Den Europaeiske Menneskerettighedskonvention, fremgaar det af retsforhandlingerne, at Den Europaeiske Menneskerettighedsdomstol i Strasbourg i en sag, den saakaldte Abdulaziz-sag ( 21 ), har fastslaaet, at der ikke paahviler de kontraherende parter nogen generel forpligtelse efter artikel 8 til at give opholdsret til aegtefaeller, der ikke er statsborgere i den paagaeldende stat .

Selbst für Artikel 8 der Europäischen Menschenrechtskonvention wurde im Verfahren vorgetragen, daß der Straßburger Gerichtshof in der Rechtssache Abdulaziz ( 21 ) entschieden hat, daß die Staaten generell nach dieser Vorschrift nicht gehalten sind, die Niederlassung von Ehegatten, die nicht ihre Staatsangehörigen sind, in ihrem Hoheitsgebiet zu akzeptieren .

Even with regard to the requirements of Article 8 of the European Convention on Human Rights, it was pointed out during the proceedings that in the Abdulaziz ( 21 ) case the European Court of Human Rights in Strasbourg held that, generally speaking, States are not thereby required to allow a spouse who is not a national to settle in their territory .
