(5) Falls die Kredit- und Finanzinstitute Zweifel hegen, ob die in den vorstehenden Absätzen genannten Kunden im eigenen Namen handeln, oder falls sie die Gewißheit haben, daß diese nicht im eigenen Namen handeln, ergreifen sie angemessene Maßnahmen, um Informationen über die tatsächliche Identität der Personen einzuholen, in deren Namen diese Kunden handeln.

In the event of doubt as to whether the customers referred to in the above paragraphs are acting on their own behalf, or where it is certain that they are not acting on their own behalf, the credit and financial institutions shall take reasonable measures to obtain information as to the real identity of the persons on whose behalf those customers are acting.

(5) Amennyiben kétség merül fel arra vonatkozóan, hogy a fenti bekezdésekben említett ügyfél saját nevében jár-e el, vagy bizonyossá válik, hogy nem saját nevében jár el, akkor a hitelintézeteknek és a pénzügyi szervezeteknek az ésszerűség keretein belül intézkedéseket kell tenniük azon személyek tényleges személyazonosságára vonatkozó információk beszerzése érdekében, akik nevében az ügyfél eljár.

(5) Dacă există îndoieli că clienții menționați la alineatele precedente acționează în nume propriu sau în cazul în care există certitudinea că aceștia nu acționează în nume propriu, instituțiile de credit și instituțiile financiare iau măsuri rezonabile pentru a obține informații asupra identității reale a persoanelor în numele cărora acționează acești clienți.
