Some of the law enforcement challenges in stopping intellectual property rights infringement over the internet include the difficulty of collecting evidence at the level of internet service providers and peer-to-peer network, the fact that the individuals behind the infringement may be residing in jurisdictions with weak enforcement, and the fact that not only providers but also users of illegal content often hide behind aliases and proxy servers.

Parmi les obstacles à la protection des droits de propriété intellectuelle contre les infractions commises dans l’Internet, on a cité la difficulté qu’il y avait à recueillir des preuves auprès des fournisseurs d’accès à l’Internet et des réseaux poste-à-poste, le fait que les auteurs des infractions résidaient parfois dans des zones où les moyens de répression étaient faibles et le fait que les fournisseurs comme les utilisateurs de contenus illégaux se cachaient souvent derrière des noms d’emprunt et des serveurs mandataires.

Ряд проблем, возникающих у правоохранительных органов с пресечением нарушений прав интеллектуальной собственности в Интернете, обусловлен сложностью сбора доказательств на уровне поставщиков Интернет-услуг и одноуровневой сети, возможностью проживания правонарушителей в странах с неэффективными правоохранительными системами, а также тем, что не только поставщики, но и пользователи незаконной продукции часто скрываются за псевдонимами и серверами-посредниками.
