Bisher hat der Gerichtshof die Wirkungen des Grundsatzes "nemo auditur" und/oder des "Estoppel"-Grundsatzes ( und damit auch die Drittwirkung von Richtlinienbestimmungen ) auf Personen beschränkt, die zur Behördensphäre gehören und für deren Verhalten der Staat somit in gewissem Umfang verantwortlich ist .

So far the Court has restricted the effect of the nemo auditur principle and/or doctrine of estoppel ( and thus the effect with regard to third parties of the provisions of a directive ) to individuals who are connected with the public authorities and for whose actions the State consequently bears a degree of responsibility .

En effet, jusqu' à présent, la Cour a limité l' effet du principe "nemo auditur" et/ou du principe de l' "estoppel" ( et de la sorte aussi l' effet à l' égard de tiers des dispositions de directives ) aux personnes qui relèvent de la sphère des autorités publiques et pour lesquelles l' État porte donc une certaine responsabilité .
