In the present case, the petitioners argue that even if they had pursued such a remedy, it would not resolve the situation because decisions of the Supreme Court declaring the unconstitutionality of a legislative provision do not have retroactive effect, meaning that while Law 49 of October 24, 1999 might be declared unconstitutional this would not remedy the situation.

En el presente caso, los peticionarios alegan que aún si hubieran presentado tal recurso, no hubiera solucionado su situación porque las decisiones de la Corte Suprema declarando la inconstitucionalidad de una norma legislativa no tienen efectos retroactivos, por lo cual solamente se podría dictar la inconstitucionalidad de la Ley No 49 de 24 de octubre de 1999, pero no se podría obtener reparación.
