وتجدد المادة 40 من القانون الأساسي تأكيد تطبيق العهد، والعهد الدولي الخاص بالحقوق المدنية والسياسية فضلاً عن اتفاقيات منظمة العمل الدولية في مقاطعة ماكاو. وتقضي المادة 40 بأن ينص القانون على أية قيود تتعلق بالحقوق والحريات التي يتمتع بها المقيمون في المقاطعة وبألا تتعارض هذه القيود مع المعاهدات السالفة الذكر.

Article 40 of the Basic Law reaffirms the application of the Covenant, the International Covenant on Civil and Political Rights as well as the International Labour Organization conventions in MSAR and stipulates that any restrictions on the rights and freedoms of the MSAR residents shall be prescribed by law and shall not contravene the aforesaid treaties.

En el artículo 40 de la Ley fundamental se reafirma la aplicación en la RAEM del Pacto, el Pacto Internacional de Derechos Civiles y Políticos y los Convenios de la Organización Internacional del Trabajo, y se estipula que cualesquiera restricciones a las que se sometan esos derechos y libertades de los residentes de la RAEM se prescribirán por la ley y no contravendrán los tratados mencionados.

L’article 40 de la Loi fondamentale réaffirme que le Pacte international relatif aux droits économiques, sociaux et culturels, le Pacte international relatif aux droits civils et politiques et les conventions de l’Organisation internationale du Travail sont applicables dans la Région de Macao, et dispose que toute restriction des droits et libertés des résidents de Macao doit être prescrite par la loi et être compatible avec les dispositions de ces instruments.

Статья 40 Основного закона подтверждает применение в ОАРМ Пакта, Международного пакта о гражданских и политических правах, а также конвенций Международной организации труда и предусматривает, что какие-либо ограничения прав и свобод должны регулироваться законом и не должны противоречить вышеупомянутым договорам.
