وقد أشار أحد الكتاب إلى أن المحكمة العليا في البرازيل قضت بأن طرد أحد رعايا رومانيا لا يمكن أن يتم بسبب رفض حكومة رومانيا إصدار جواز سفر له، وقال: ”هناك حاليا طرح قوي يؤيد الفكرة القائلة بأن حيازة جواز السفر حيازة فعلية يدل على الواجب الذي يقع لزاما على الدولة المصدرة لجواز السفر بالسماح لحائزه بالدخول مجددا، إذا طرد من دولة أخرى وليس لديه مكان آخر يمكن أن يتوجه إليه.

Relevant à ce sujet que la Cour suprême du Brésil a constaté qu’une mesure d’éloignement qui frappait un ressortissant roumain ne pouvait être mise à exécution parce que le Gouvernement roumain refusait de délivrer un passeport à l’intéressé, un auteur écrit : « Il existe aujourd’hui un corps de doctrine important à l’appui de l’idée que la possession d’un passeport met l’État qui l’a délivré dans l’obligation de réadmettre le titulaire si celui-ci fait l’objet d’une mesure d’éloignement de la part d’un autre État et n’a aucun autre lieu où aller.

Отмечая в этой связи заявление Верховного суда Бразилии о том, что выдворение румынского гражданина не могло быть осуществлено из-за отказа румынского правительства выдать ему паспорт, один автор пишет: «В настоящее время имеется обширная доктрина, подтверждающая, что обладание паспортом указывает на обязанность выдавшего паспорт государства вновь допустить в страну обладателя паспорта, если он выдворен из другого государства и ему некуда больше податься.
