وينص إعلان المبادئ الدنيا المتعلقة باستقلال الأجهزة القضائية والقضاة في أمريكا اللاتينية، الذي اعتمدته الجمعية العامة لاتحاد قضاة أمريكا اللاتينية في عام 2008، على أن القضاة، كقاعدة عامة، لا يتحملون شخصياً مسؤولية مدنية عن قراراتهم باستثناء حالات الاحتيال أو سوء السلوك المتعمد.

The Declaration of Minimum Principles on the Independence of Judiciaries and Judges in Latin America, adopted by the General Assembly of the Latin American Federation of Judges in 2008, states that, as a general rule, judges are not personally civilly liable for their decisions, with the exception of cases of fraud or intentional misconduct.

La Declaración de Principios mínimos sobre la independencia de los poderes judiciales y de los jueces en América Latina, aprobada en 2008 por la Asamblea General de la Federación Latinoamericana de Magistrados, establece que, como regla general, los jueces no responderán civilmente de manera personal por sus decisiones, salvo en los casos de dolo o de mala conducta intencional.
