وكانت الحكومة المؤقتة العراقية قد سنّت نظاماً أساسياً جديداً في عام 2005، بُني على النظام الأساسي السابق، وغيّر اسم المحكمة إلى "المحكمة الجنائية العراقية العليا".

The Iraqi Interim Government enacted a new statute in 2005, built upon the earlier statute, which changed the tribunal’s name to “Supreme Iraqi Criminal Tribunal”.
