c) The Committee notes that, following a decision of the Eastern Caribbean Court of Appeal, confirmed by the Judicial Committee of the Privy Council, in the case of Hughes and Spencer v The Queen, the death penalty, where applicable, is no longer applied in a mandatory fashion but is subject to a separate sentencing hearing at which the judge is required to consider the circumstances of the case and of the person convicted
