Moreover, for such an offence, the Attorney General has the right, in accordance with section 393 (7) of the Code of Criminal Procedure, to file an indictment in the High Court or to decide that non-summary proceedings will be held before the Magistrate’s Court, “having regard to the nature of the offence or any other circumstances”.
