EU má rovněž za to, že se jedná o případ zvláštní naléhavosti, což na základě čl. 96 odst. 1 písm. a) téže dohody opravňuje k tomu, že není nutné vyčerpat možnosti politického dialogu stanovené článkem 8.

Außerdem ist die Europäische Union der Auffassung, dass es sich um einen besonderen Notfall handelt, der es rechtfertigt aufgrund von Artikel 96(1a) desselben Abkommens, dass es nicht notwendig ist, die Möglichkeiten des politischen Dialoges, vorgesehen von Artikel 8 des Abkommens, zu erschöpfen.
