وفيما يخص الادعاءات المتعلقة بالتعذيب، لا تحدد الحكومة القانون المنشئ لوكالة الاستخبارات الوطنية ولا القانون الذي يخول لهذه الوكالة اعتقال المشتبه بهم وممارسة مهام الشرطة القضائية، وبخاصة مباشرة إجراءات الحبس الاحتياطي دون منح المشتبه به الحق في مقابلة محاميه أو الخضوع لفحص طبي.

As to the allegations of torture, the Government does not specify the provisions establishing the National Intelligence Agency or the rule authorizing the Agency to arrest suspects and perform the duties of the criminal investigation police, such as remanding a suspect in custody without allowing him to consult his lawyer or be examined by a doctor.

Por lo que respecta a las denuncias de tortura, el Gobierno no especifica la norma en virtud de la cual se crea el ANR ni la que autoriza a este organismo a detener a sospechosos y a ejercer funciones de policía judicial, que abarcan, entre otras, privar de libertad a un sospechoso sin que tenga derecho a recibir la visita de su abogado o a ser examinado por un médico.

В связи с утверждениями о применении пыток правительство не указало ни нормативный акт о создании НРА, ни нормативный акт, позволяющий НРА задерживать подозреваемых и брать на себя функции уголовной полиции, в частности заключать под стражу без предоставления подозреваемому права на встречу с его адвокатом и на осмотр врачом.
