إذا ظهر بوضوح للسلطة المتعاقدة أن المفاوضات مع مقدم العرض المدعو للتفاوض لن تؤدي إلى إبرام عقد الامتياز، فعليها أن تعلم مقدم العرض باعتزامها إنهاء المفاوضات وأن تعطيه وقتا معقولا لصوغ أفضل عرض نهائي لديه.

If it becomes apparent to the contracting authority that the negotiations with the bidder invited will not result in a concession contract, the contracting authority shall inform the bidder of its intention to terminate the negotiations and give the bidder reasonable time to formulate its best and final offer.
