하지만 1962년 제정된 군형법 제92조의6은 군인들 사이에 일어난 성행위를 처벌하는데 이용되어왔다. 이에따라 군인들은 동성 성관계의 합의 여부와 성관계가 군부대 안 또는 밖에서 일어났는지의 여부와 상관 없이 군형법 제92조의6의 “추행” 조항에 따라 2년이하의 징역형에 처해질 수 있다.
